Death Penalty and Death Penalty Opponents

Many who are against the death penalty point to people often enough to garner attention, who are found innocent through DNA evidence and are freed after 15-20 years.

The key here is the DNA evidence.  These folks being found innocent were convicted before DNA evidence was used or widely used.  So,  (1)If DNA evidence was used when these people were convicted, they may not have been convicted in the first place, and (2) people who are now convicted using DNA evidence are FAR less likely to be found innocent after 15-20 years.


In 20 years, we are not going to be hearing about many people at all released from death row because of new evidence.

Anticipating at least one argument:
Sure, DNA evidence Can be planted but how often is that going to happen..perfection is impossible.


I've had this thought recently, then noticed This Post over at Sig's place.

  1. Yea, they can plant DNA and railroad someone.
    Or, just get some pro witness to say that's the defendants DNA.
    If the defendant is to be railroaded the defense will be denied discovery.
    And, so it goes in the land of Tyrants.

    1. TS/WS - but it is much better than it used to be. Many fewer innocents will be convicted. And the post at Sig's place makes a real good case for how the death penalty reduces crime and murder.

    1. TS/WS, I didn't hear that. Has to be lip service. Based on the idea that there was no civil trial, this Zimmerman case is as dead in the water as can possibly be.

  4. I have for some time thought there is a pretty obvious solution to the death penalty problem.

    Where the death penalty is called for, put the convict in a death-row cell with no direct communication with any other cell or with a guard-station , modified slightly from current norm, such that in the cell would be a revolver for which the inmate would be given a single cartridge.

    The major modifications will involve a mechanism where the inmate can turn in te cartridge in return for trips to the exercise yard, doctors, and so on. The cartridge would be returned as soon as the inmate is safely back in the cell.

  6. Sig's got it right: the death penalty is a penalty for heinous crimes, punishment for the evil doer and justice for the victim's loved ones. Deterrence is just gravy, but was never the primary intention.

    Deterrence, de-schmerrance. Gas the murdering son of a bitch, and be done with it. Note: murder is not the only offense that garners the death penalty: desertion by a soldier in the face of the enemy warrants the death penalty. Treason against the US also gets death. A few others that don't come to mind other than murder are out there.

    I liked Bob Graham's comment (D-FL) when as governor he was asked how many more people he was going to kill by upholding the Florida death penalty: "as many as come across my desk."

    Ah, what ever happened to the Democrats of old?

    1. Fredd, Exactly. Some people are simply defective. One here in Cincinnati declared himself a monster in the sentencing phase of his trial and told the judge he needed to be put down. It seems at times libtards give No Quarter to the victims or their loved ones. Which is bullshit.

      I think the guilty person should be restrained in a room, and the family of the victim given a baseball bat or a weapon of choice, and as much time as they'd like to dispatch justice.

  7. A guy here in Houston lost two sons - the victims
    of a drunk driver, as they pushed a stalled car.
    The drunk driver was killed later, a shot to the...
    the gun was never found and the father was declared not guilty,
    by a jury in a court of law.
    So, maybe the remedy would not be dispatched in the presence of the system.

  8. Kid: still waiting for that 10% - 12% correction. Any time, now, right? Market closed today, still around a little less than 1% off of it's all time high.

    And it will go higher, MUCH higher before the correction hits. Dow to hit 20,000, and you can take that to the bank. And my money is where my fingers are: 80% equities in my portfolio. Solid equities, not flaky stuff (other than PHOT, which I am waiting to make a comeback).

    2. Nope, my theory still holds: Obama has kept our GDP exceptionally low with his God awful socialist policies, and the 20,000 Dow should have been achieved by now. But, much live molten lava, that GDP activity doesn't just disappear, it builds pressure.

      Once Obama is either deemed irrelevant (with a massive GOP landslide in November), or his socialism is repudiated otherwise, the magma of the American soul will spew forward towards what should have been its equilibrium much earlier.

      The Dow tanking is just not possible right now, regardless of how bad things seem. There is only one way the market is going to go: straight up like a rocket. Once it hits 20,000, then the profit takers can cash in. But not until then.

      You heard it here first.

    3. Fredd, I agree with you. We are in a multi-year bull market. I was looking for a 10-12% pullback. I think we get it and I will likely be a little off on the timing. I recently read where the market has never been this strong for this long. Imagine that. And it has much more to go.

      I read S&P500 to 2850 or so by 2020. It could happen. That's probably fairly aligned with DOW 20000.

      But Market tops are made on good news. The very best news. Because when it is that good and it can't get better then it has to get worse sell the market. Bottoms are made on the worst news. Gonna be darned interesting.

      And yes Great call of yours on the Gold. You made out better than I did on the Dust. I did well, but you really nailed the entry and exit.

  10. I have no problems with the death penalty for as long as we can trust elected officials. There have been too many cases of railroading defendants, however, in order to get re-elected. If the power of the state wants to screw you ... it will.

    1. Mustang, Yep. I don't think that can be avoided in any case so I'd say we have to separate the corruption from the dispatching of criminals. One of those perfection is impossible things. Maybe if there isn't DNA evidence it can only be life ?
      I could live with that as long as rock solid evidence such as DNA and/or video resulted in the execution a lot faster than it does today.

    I'm just saying that if someone takes on the big boys,
    you have to take what happens next,
    "I regret that I have but one life to give to my country"; or something close to that.
    If the Congress passes the ["Incumbent Protection Act"] that says if you and or me
    says anything negative about the elected power addicts--SATURDAY NIGHT liVE could be over nite criminals,
    so would we. Does back POST Count?
    That ---and Immigration Reform ---will be included in the Continuing Resolution (budget) Bill.
    Maybe December, since they delayed the vote today.

    1. TS/WS. I'm willing to put stipulations on the death penalty in the area of minimum evidence quality be that eye witness or DNA, etc. but in the end shit happens. Life ain't fair and criminals cannot be given an inch. Especially those committing heinous crimes.

      I think -at best- congress thinks massive immigration will help fund social security. But it won't. These people aren't going to be tax payers.

    2. True story... Perhaps 15 years ago, there was a community movement to build a new jail right next in "Little Tokyo", or specifically in a lot adjacent to my Buddhist temple. Jails were overcrowded, filled with the "usuals" from our segregated communities. They REFUSED to allow the new jail to be built back in THEIR neighborhoods

    3. P47koji. Understood. Dang, I'd say there is room for plenty of jail space anywhere along I-40 through Texas. There is also room for a 35 mile by 35 mile landfill, that according to Penn and Teller, would last the USA 1000 years. Throw in a nice little town with golf courses and all the hot spots for the people running the jails and we're set. I might even retire there as my wife dreams about owning a restaurant on an interstate somewhere.
